摘 要

随着时代的发展，社会的现代化进程不断加快，人们对于政府契约治理机制研究的关注也越来越多。政府契约治理作为一种新的政治管理方式，对于建设契约型政府和服务型政府具有重要意义。随着市场经济的发展和完善，人们纷纷意识到市场机制本身的局限性，而政府的干预也具有一定缺陷。以是，当局治理必需通过契约明确市场与政府之间的权利和义务，来规范它们的行为以避免市场或政府失灵。其次，政府长久以来在国家以及社会治理中一直处于绝对权威的地位，因此在没有完善或者缺乏契约机制的情况下，造成社会资源的垄断，从而引发各种社会不公官僚主义等问题。是以创新政府治理模式，建立公正合理的政府契约机制是需要的，这有利于社会公平与正义的维护，促进社会与经济的稳定发展。最后，随着新时代即信息时代的到来，人类的生活方式、思考方式都发生了明显的变化，因此政府治理机制必然也会随着时代而发展，而契约治理这一模式正是符合新时代观念并且满足人民群众要求的一种治理机制。

本文在分析相关文献资料和以武汉地铁建设为个例进行分析的基础上，探讨了地方政府契约治理的理论特点、地方政府契约治理运行机制以及地方政府契约治理机制的改革创新等方面。

Abstract

With the development of society,The process of social modernization is accelerating,People pay more and more attention to the research of government contract governance mechanism.As a kind of new political management mode, the government contract governance is of great significance to the construction of contractual government and service-oriented government.With the development and improvement of market economy, people are aware of the limitations of the market mechanism itself, and the government intervention also has some defects. In order to regulate their behavior in order to avoid market or government failure, it is necessary to regulate the rights and obligations of the market and the government by the contract. Secondly, government for a long time in the country and social governance has been in a position of absolute authority, and therefore not perfect or lack of contract mechanism, caused by the monopoly of social resources, causing social injustice bureaucracy and other problems. So it is necessary to establish a fair and reasonable government contract mechanism, which is conducive to the maintenance of social fairness and justice, and to promote the stable development of society and economy. Finally, with the arrival of the new age, the information age, the way of life, the way of thinking has changed obviously, Therefore, the governance mechanism of the government will also develop with the times, and the mode of contract governance is a kind of governance mechanism that conforms to the concept of the new era and meet the demands of the people. 

This paper is based on the analysis of relevant literature and the construction of Wuhan subway , and this paper explores the theoretical characteristics of local government contract governance, local government contract governance mechanism and the reform of local government contract governance mechanisms and other aspects.

1.1 选题的目的和意义

随着社会现代化进程中，市场经济的不断发展，人们对关于政府契约治理的问题的关注和研究越来越多。在传统国家和社会的治理中，政府一直以来都以一种绝对权威性的姿态来进行管理，这种情况在早期社会公平机制和权力制约还没有建立或完善时更为明显，因此这就容易造成政府权利大于其他一切的现象，进而使得政府拥有独特的权利，甚至造成社会资源的垄断，从而造成社会的不公，引起民众不满。契约治理模式则规范了政府和市场的权力及义务，有利于促进社会公平，促进社会的稳步发展。另外，随着新时代的来临，政府面临的是一个人人享有信息知识权的信息时代，跟上时代的步伐，建立新的政府契约机制符合新时代观念并且满足人民群众要求，这也是随着时代进步的一种能够体现。

作为一种突破传统行政管理模式的新政府治理模式，契约治理在理论上打破了社会中长久存在的两分法传统思维方法，并且走出了“政府中心论”的局限，开始重视国家和社会的互动与合作，强调了国家和社会之间的契约关系。因而契约治理对于我国政府治理的内在机制的探究、研究领域的拓宽，政府和市场角色的重新定位，以及市场、政府、公民三者相互依赖与合作的新型关系都有极其重要的理论价值。同时，契约理论对于构建服务型政府，加快政府改革，促进社会发展，完善公共服务，全面建设小康社会具有重要意义。
