摘 要

“食以安为先”，食品安全问题一直以来都是人们关注的重点。近年来食品安全问题频发，引发民众的恐慌，因此完善我国食品销售环节的安全监管是非常必要的。本文通过研究中国食品销售环节安全监管的发展，从食品安全监管的法律法规、监管机构和监管制度方面指出了目前食品销售环节安的监管现状及存在的一些问题，主要体现在法律体系不完善，监管机构职能不清和保障体系不健全。通过对中美食品销售环节安全监管的比较，重点比较了中美的监管立法，监管模式和监管主体，可以看出美国在食品安全监管方面的先进之处，并从法律法规、监管机构和监管保障体系等方面提出了一些完善我国食品销售环节安全监管的对策，如完善法律体系，调整监管职能，建设完善的事前、事中和事后机制。风险评估机制、社会共治制度和食品召回制度等的完善建立能有效的提高我国食品安全监管效率。

Research On The Safety Supervision Of Chinese Food Sales

Abstract

To the foodstuff safe is all-important. Food safety issues have always been the focus of people’s attention. In recent years, China's frequent food safety problem has caused people’s panic.So it’s very necessary for the link of sale of China's food safety to supervise. Through the study of the development of China's food safety supervision, from the aspects of the supervision of food safety laws and regulations, regulatory agencies and regulatory system, this article points out the present situation and some existing problems of the sale of part of the food safety supervision in China. These problems mainly reflect in the legal system, the function of supervising and managing organization and security systems. Besides, through the comparison of the sales of food safety supervision between China and US, especially in the regulatory legislation, supervision mode and the supervision of main body, it shows that Americans has advantages in the food safety supervision. This paper puts forward some measures to improve the safety supervision of food sales in China from the aspects of laws and regulations, regulatory agencies and regulatory protection system,such as improving the legal system and regulatory functions, improving the construction of supervision before the event, at present and after the event. The establishment of risk assessment mechanism, social governance system and food recall system can improve the food safety supervision effectively in China.
