摘 要

随着经济发展水平的提升，人们的社会观念发生了很大的变化，婚内不忠行为频发，严重干扰了夫妻之间的婚姻关系。而现代公民权利意识不断增强，为了保证婚姻的质量，维护自身的财产和婚姻利益，越来越多的夫妻想到订立协议来制止婚内不轨行为。但是法律至今未对此做出详细规定，法官也就缺乏判案的法律依据，因而法官行使自由裁量权，所以出现很多“同案不同判”的现象。学者对忠诚协议的效力也各持己见，尚未形成通论。本文就是以夫妻忠诚协议为研究对象，试探索解决关于夫妻忠诚协议效力的问题。

夫妻忠诚协议是夫妻双方对自身婚姻关系进行事先约定，以起到风险预防的作用，符合婚姻自由的原则，法律应当认可它的效力并对其做出具体规定。本文对夫妻忠诚协议进行了概述，介绍关于夫妻忠诚协议效力的有关争论，最后从实体和程序两方面分析，提出夫妻忠诚协议效力的规制与完善。

Study on the Effectiveness of Loyalty Agreements

Abstract

With the improvement of economic development level, people's social concept has changed greatly, and the frequent behavior of marital infidelity seriously interferes with the marriage relationship between husband and wife. In order to ensure the quality of marriage and safeguard their own property and marriage interests, more and more couples are thinking of entering into agreements to stop marital misconduct. But the law has not yet made a detailed provision on this, judges also lack the legal basis for adjudication, so judges exercise discretion, so there are a lot of "same case different judgment" phenomenon. Scholars also hold their own opinions on the validity of loyalty agreements and have not yet formed a general theory. This article is Husband and wife loyalty agreement is the research object, try to solve the problem about the validity of husband and wife loyalty agreement.

Husband and wife loyalty agreement is a prior agreement between husband and wife on their own marriage relationship, in order to play the role of risk prevention, in line with the principle of freedom of marriage, the law should recognize its effectiveness and make specific provisions for it. This paper gives an overview of the marital loyalty agreement, introduces the dispute about the validity of the husband and wife loyalty agreement, and finally analyzes the entity and procedure, and puts forward the regulation and perfection of the validity of the husband and wife loyalty agreement.

一、问题的提出

现代社会背景下，婚姻关系越来越脆弱，离婚率激增，更多的年轻夫妻为了保证婚姻忠诚，开始通过签订夫妻忠诚协议的方式来约束婚后双方行为，保证自己的财产和婚姻利益。

目前《民法典》已经于2020年5月28日审议通过，将于2021年1月1日起正式施行，现行《婚姻法》同时废止，其中第1043条的规定，^[1]被认为是我国法律对夫妻忠实义务的直接描述，第1043条将婚内道德义务法定化，推动建立和睦的家庭关系。但是法条中缺乏对忠实义务的具体内涵的说明，让该条看起来更像是倡导性规定，缺乏强制力。往往法律规定了义务，就会有相应的责任，违反忠实义务没有明确不利后果，就缺乏相应的操作性。

《民法典·婚姻家庭编》第1043条规定了夫妻忠实义务，并在第1091条规定了离婚损害赔偿请求权。^[2]第1091条规定只有在重婚和有配偶者与他们同居两种情况，无过错方才享有离婚损害赔偿请求权，这是两种非常严重违反夫妻忠实义务的情形，现实中更多的婚内出轨行为导致婚姻破裂的，法律并没有提供救济手段。所以夫妻双方为了保证自己合法权益，才会想通过法律途径以外的救济手段，签订忠诚协议的方式来保证婚姻的和睦。夫妻双方通过签订忠诚协议的方式对第1043条加以明确，也得到了大家的认可，越来越多的夫妻开始效仿。但是关于忠诚协议效力问题，大家莫衷一是，至今没有官方准确的通说。
