摘 要

法官是司法权的法定行使者，是通过案件审理实现个案正义的居中裁判者，同时也是司法改革的重要主体及对象。法官作为司法的主体，在司法改革中具有重要角色。如果法官作为主体的积极能动作用无法发挥，改革方案运行过程中极有可能遇到阻力。针对目前2014改革方案在具体推行过程中产生相应问题，本文试图站在法官主体角色定位的角度，分析如何调动法官推动司法改革的积极性，并对发挥法官在司法改革中的主体积极作用，提出一些粗浅的看法与建议。

文章对司法改革中法官角色定位的阐述主要分为四个部分。第一部分，笔者以司法与司法改革为切入点，通过界定司法与司法改革的主体，论证法官在司法改革中具有的双重角色。第二部分中，通过对此次司法改革的相关内容措施进行阐述与分析，论证司法改革对法官角色的定位。第三部分，主要对目前2014改革方案具体境遇进行阐述，从法官在司法改革中角色定位角度出发，分析法官流失等现象存在的原因。最后一部分，站在法官司法主体地位的立足点，笔者试图提出相关建议，充分发挥并利用法官在司法改革中的主体积极作用，从而推动并保障2014改革方案的顺利进行。

The role of judge in judicial reform

Abstract

Judges are legal exercise of judicial power, was the case by case to achieve justice center referee who is also an important subject and the object of judicial reform. Judges as the main judicial, have an important role in the judicial reform. If the judge role is negative qualitative reform program during the operation it is likely to encounter resistance. 2014 reform program for the current problems to produce the corresponding specific implementation process, the paper attempts to locate the principal role of the judge to stand, it analyzes how to mobilize the enthusiasm of the judges to promote judicial reform, and actively play the main role of judges in the judicial reform proposed superficial author the views and suggestions.

（一）研究背景

法官是司法制度运行的重要主体，而司法改革使司法制度不断前进与完善。目前2014改革方案通过理顺体制关系、优化职权配置、强化职业保障、加强人权司法保障等具体措施的落实，努力让人民群众在每一个司法案件中感受到公平正义，树立司法权威性，最终实现司法公正。然而，在2014改革方案的实施并非一帆风顺，在具体推进中遇到一些阻力，2014改革方案中，法官角色的被动与消极在一定程度上影响了改革进程，部分法官以消极离职方式应对改革方案的落实。

在此背景之下，本文试图通过分析法官在特定环境即司法改革大环境下的角色定位，探讨其定位存在的相关问题及其产生原因，并且针对存在问题提出笔者的若干想法，寻求可行有效的解决机制，以期充分发挥法官的积极能动作用。
