摘 要

无人驾驶汽车利用计算机与传感器使车辆自动行驶，不但能减轻驾驶者的负担，还能提高交通效率，受到了广泛关注。我国无人驾驶汽车研究已取得丰富成果，然而法规和政策的缺失限制了无人驾驶汽车的发展，如何弥补相关法规政策的不足是目前的研究热点。

本文主要研究了我国无人驾驶汽车的法规和政策存在的问题与对策。首先，介绍了无人驾驶汽车的定义并回顾其发展历史，结合如今无人驾驶汽车在我国与国外的发展情况，分析了相关法规政策研究的必要性；其次，阐述了我国现有的无人驾驶汽车相关法规和政策，提出了存在的主要问题；最后，比较研究了汽车工业发达国家的相关法规政策，同时参考国内的相关研究，提出了完善我国无人驾驶汽车法规政策的可行对策。

研究成果表明，我国现有的相关法规政策存在的问题有：没有赋予无人驾驶汽车道路通行权；没有制定完善的技术标准和监管制度；没有明确发生事故时的责任划分和保险制度；没有保障驾驶者的隐私权和网络安全；没有提出具体的产业扶持措施。

本文的特色在于基于我国现有的无人驾驶汽车法规政策，运用文献分析法和比较研究法，在国外的先进法规政策的基础上，提出了完善相关法规政策的建议，包括添加特殊条例赋予道路通行权、制定无人驾驶汽车独特的标准体系和监管体系、制定以车为核心的责任体系和保险制度、出台法规保障无人驾驶系统的隐私权和网络安全、出台政策扶持无人驾驶汽车产业。

Abstract

Driverless cars use computers and sensors to drive automatically, which can not only reduce the burden of drivers, but also improve the traffic efficiency, and has been widely concerned. The research of driverless cars has achieved rich results, but the lack of statutes and policies limits the development of driverless cars. How to improve the shortcoming is the research hotspot now.

This paper mainly studies the problems and Countermeasures in the statutes and policies of driverless cars in China. First of all, this paper define the driverless car and introduce its development process. Combined with the development of driverless car in China and abroad, it analyzes the necessity of research on relevant statutes and policies. Secondly, it expounds the existing statutes and policies of driverless car in China and puts forward the main problems. Finally, it compares and studies the relevant statutes and policies of the developed countries of automobile industry, At the same time, referring to the relevant domestic research, the paper raise the advices to improve the statutes and policies of driverless cars in China.

The research results show that the problems of statutes and policies are: no right of way for driverless cars; no sound technical standards and regulatory system; no clear responsibility division and insurance system in case of accidents; no protection of the privacy and network security of drivers; no specific industrial support measures.

The characteristics of this paper are using the methods of literature analysis and comparative research, on the basis of the advanced statutes and policies in foreign countries, then puts forward suggestions to improve the relevant statutes and policies, including adding special regulations to give the right of way, formulating the unique standard system and anminister system of driverless cars, and formulating the duty with cars as the core The system and insurance system, the introduction of statutes and regulations to protect the privacy and network security of the driverless system, the introduction of policies to support the driverless car industry.

第1章 绪论

1.1 课题研究的背景

无人驾驶汽车是自动驾驶等级最高级的自动驾驶汽车，它能通过传感器识别车辆周边的情况，利用车联网技术设计前往目标地点的路径，再由计算机控制车辆，达到无人驾驶的目的。无人驾驶汽车不但可以减轻驾驶者的工作负担，而且依靠计算机的控制，无人驾驶汽车可以有效减少汽车事故的发生，还能在车联网的协调下缓解交通堵塞现象，提高交通效率。在汽车数量越来越多、各地交通堵塞的问题越来越严重、汽车意外事故越来越频繁的今天，智能交通的研究受到了广泛关注，而作为智能车辆发展的最终方向，自动驾驶汽车尤其是无人驾驶汽车成为了各国的研究重点。无人驾驶汽车具有重要的现实意义，对推动汽车工业技术创新具有重要作用^[1]。

我国从20世纪80年代开始研究无人驾驶汽车，经过数十年的发展，一部分机构与企业已经成功研制出无人驾驶汽车，进入了封闭区域的道路测试阶段。从技术上看，无人驾驶汽车的产业化与市场化指日可待，然而无人驾驶汽车的普及除了技术层面的要求，还有法律层面的要求。无人驾驶汽车相关的法规和政策的出台仍处于起步阶段，世界上最早的相关法规出台至今还不到十年。为了给本国无人驾驶汽车的发展清扫障碍，解决新技术带来的法律问题，同时在全球无人驾驶汽车的产业化中抢占先机，很多国家开始了相关法规政策的研究。
