摘 要

民以食为天，食以安为重。现如今，食品安全事件频发，有关食品安全的相关消息都会引起百姓早就绷紧的神经。怎样保障食品安全，让广大百姓能食用上安全健康合格的食品，已经成为一大社会问题。频繁曝光的食品安全问题对广大民众的健康和生命造成了巨大的威胁，同时也对社会、经济甚至是政治产生了很大的影响。不管是在发展中国家还是在发达国家，都同样面临着严峻的食品安全危机，其危害的广泛性和结果的严重性引起了世界各国的关注。从这个意义上来讲，食品安全问题拷问的是一国政府的公共管理水平。而在我国，这个问题尤为突出。细数过去曝光过的诸如三聚氰胺奶粉事件，瘦肉精、苏丹红以及近期曝光的脚臭盐，不难发现，消费者和媒体往往都是冲在第一线的，不断的发掘和曝光各种视频安全问题，反观政府方面却时常出现一种慢人一拍的现象。

我国自2009年颁布实施《食品安全法》以来，社会中仍有大量的食品安全问题出现。本文从法律与政府的监管出发，从消费者在面对食品安全的困境中分析食品安全的法律缺陷与食品安全在监管中存在的问题，并针对这些问题提出相应的解决建议。

How to protect food safety, so that the majority of people can eat safe and healthy qualified food, has become a major social problem. Frequent exposure of food safety issues to the general public's health and life caused a huge threat, but also on society, economy and even political had a great impact. Whether in developing countries or in developed countries, are also facing a severe food safety crisis, the breadth of its harm and the seriousness of the results of the world's attention. In this sense, food safety issues are tortured by the government's public management level. In China, this problem is particularly prominent. Breakdown of the past exposed such as melamine milk powder incident, clenbuterol, Sudan red and the recent exposure of the foot odor, it is not difficult to find that consumers and the media are often rushed in the first line, and constantly explore and exposure of various Video security issues, the other hand, the government has always been a slow phenomenon of a beat.

Since the promulgation of the Food Safety Law in China in 2009, there has been a lot of food safety problems in the society. This paper analyzes the legal defects of food safety and the problems existing in food safety from the point of view of the regulation of law and government, and puts forward the corresponding solutions to these problems from the dilemma of consumers in the face of food safety.
