摘要

随着互联网时代的发展，网络直播行业逐渐兴起，并在2016年一年内吸收大量资本，迅速崛起。网络直播行业的崛起的同时，其所面临的法律风险也逐渐显现。网络直播内容涉黄赌毒，侵犯版权和隐私权，对网络直播平台及主播税收征管难，网络主播权利保障问题等成为网络直播行业面临的一系列法律风险，成为限制网络直播行业发展的因素，对健康的互联网环境甚至良好的社会秩序造成威胁。我国在近些年来也针对网络直播行业出台了系列的规章。但对网络直播监管法律体系的构建在立法、执法和司法实践各方面仍存在一些不足之处。研究网络直播行业发展过程可能面临的法律风险，并通过借鉴国外先进的立法经验，完善我国对网络直播行业的监管制度成为保证网络直播行业健康可持续发展，营造健康的互联网环境的一大课题。

Abstract

With the development of the internet age, the network broadcast industry has been booming and has been developing rapidly since 2016. In one year, the network broadcast industry absorbs a lot of capital, rapid rise. With the rise of the network broadcast industry, the legal risk was appearing gradually, the network broadcast program involves the illegal content such as pornography and violence, the problem of the network broadcast platform and the host's tax collection and management, the question of the right guarantee of the network anchors, etc. Poses a threat to a healthy Internet environment and even good social order. China in the past few years for the network has also launched a series of laws and regulations. However, there are still many imperfections in the construction of the legal system of network direct seeding from legislation enforcement to judicial practice. The purpose of this paper is to analyze the legal risks in the process of the development of the network direct seeding industry, and to make practical suggestions for perfecting the relevant system of legal regulation of the network broadcast through the reference of foreign advanced legislation experience.
