摘 要

本文将对江苏省环保民间组织参与环境公益诉讼的若干问题进行分析研究，本文共分为三部分：第一部分介绍了环保民间组织参与环境公益诉讼的概念及意义。本部分首先介绍了环保民间组织和环境公益诉讼两个概念，然后论述环保民间组织参与环境公益诉讼的实践意义。第二部分总结了环保民间组织参与环境公益诉讼的现状及困境，从而指出环保民间组织要想更好地参与环境公益诉讼，必须不断克服各方面的困难。第三部分针对环保民间组织遭遇的各类阻碍提出若干建议。本章将结合环保组织在现实中遭遇的困境，从加强环保组织自身建设、确保环保组织资金来源、改革环保组织的登记管理制度等角度，为环保组织充分参与环境公益诉讼建言献策。

Study on the problem of environmental public interest litigation in Jiangsu Province

Abstract

This article will analyze some problems of participation in environmental public interest litigation environmental non-governmental organizations in Jiangsu Province, this paper is divided into three chapters:The first chapter is the theoretical basis of environmental non-governmental organizations involved in environmental public interest litigation. This chapter mainly discusses the basic concept of environmental non-governmental organizations and environmental public interest litigation, and introduces the theoretical basis of participation in environmental public interest litigation environmental NGO thus obtains the legitimacy of environmental non-governmental organizations involved in environmental public interest litigation.The second chapter summarizes the current situation and difficulties involved in environmental public interest litigation, environmental NGOs, which pointed out that environmental non-governmental organizations to participate in environmental public interest litigation, to overcome all difficulties.The third chapter discusses the perfection of the system of environmental civil society organizations involved in environmental public interest litigation. This chapter will be combined with environmental organizations encounter in the predicament in reality, from the angle of legislation to expand the system for the registration and administration of the qualification of the plaintiff, strengthen self— construction, reform and environmental protection organization. For environmental organizations to participate fully in the environmental public interest litigation system perfect.

引 言

我国某些地区在一味追求经济利益的同时出现了资源短缺、能源危机、环境污染以及生态功能严重退化等严重危害人类自身生存的问题。江苏省是改革开放的前沿阵地，依靠其得天独厚的地理优越性以及正确的决策使其经济得到快速发展。近年来，随着人们环保意识的不断增强，对于保护环境、节约资源的愿望日益强烈，政府、公民个人以及社会团体不断参与其中。但是，由于环境污染案件中主体具有不特定性，诉讼法上对适格原告要求为直接利害关系人加上起诉要求有明确的被告、诉讼请求，但环境侵害往往具有不确定性、潜伏性，受害人常常难以判断加害者，这些都为环境维权增加了不少难度。

在过去的十几年里，国家为了更好地保护环境、节约资源，尝试建立环境公益诉讼制度，在不少的相关法律法规中都对环境公益诉讼作出规定，旨在建立一个符合我国国情的环境公益诉讼制度。
