摘 要
近年来,随着共享经济的崛起,人们的生活在各方面都产生了明显迅速的不同。共享经济以互联网等现代技术为基础,涉及租车、短租、金融等多种行业,其在给社会公众带来极大便利的同时,也隐藏着难以预料的法律风险。民宿共享短租即为共享经济背景下新兴产物之一,其依托互联网共享平台,利用大量空置房源,将房源与租客联系起来,从而为房东和租客实现租住交易的商业模式。作为租赁市场上具有发展潜力的新兴行业,在民宿共享短租火热发展的背后,还存在着管理混乱、责任不均、法律保障缺失等等问题。本文通过对我国民宿共享短租的概念、发展现状及存在问题进行研究,对比域外国家共享短租法律规制,提出完善我国民宿共享短租的法律规制方法。本文由摘要和正文组成,正文部分分为四个部分进行论述:
第一部分,概述民宿共享短租的基础理论。首先从法学的角度上对民宿共享短租的概念做出了界定,并将其与相近概念加以区分。其次简要介绍我国民宿共享短租的发展。
第二部分,阐述我国民宿共享短租中存在的法律主体及其之间的法律关系,并概述我国民宿共享短租法律规制的现状及存在的问题。在阐述我国民宿共享短租法律制度现状的基础上,说明我国民宿共享短租法律制度存在的问题。
第三部分,参照域外民宿共享短租发展较为领先的国家法律制度,主要包括美国、英国、日本和台湾,据此作出我国与域外民宿监管法律制度的比较,概括总结出对我国民宿共享短租法律规制方面的有利措施。
第四部分,通过对前文三个部分的概括总结,发现我国民宿共享短租在法律制度层面的不足。在借鉴国外有益经验的基础上,结合我国的客观实际情况,针对我国民宿共享短租法律规制提出可行性建议。

The legal regulation of sharing short rent of homestay in China
Abstract
In recent years, with the rise of the sharing economy, people's consumption and lifestyle have experienced remarkable transformations. The sharing economy, based on modern technologies such as the Internet, involves a variety of industries such as short-term rental car finance, which not only brings great convenience to the public, but also hides unpredictable legal risks. Home stay facility sharing rent is one of shared economy under the background of new products, relying on the Internet sharing platform, using a large number of vacant homes, the houses with tenants, to the landlord and tenant rented the trading business model sharing short rent refers to the landlord or housing to enter through the network platform to release empty homes and price information, sales of the short-term use of the building, there are traveling on business or other tenants living demand can browse search housing information, communicate with distributors and realize the rent trading business model. As a potential new industry in the rental market, sharing short rent is very popular, but behind the hot, the lack of the question of the concept of home stay facility sharing rent in China to study the current situation and existing problems, compared to countries outside share the rent law regulation, proposed consummates our country the legal regulating of the home stay facility sharing rent method consists of the introduction of text and epilogue, this article main body part is divided into four parts:
In the first part, the basic theory of shared short rent of homestay is summarized. Firstly, the concept of shared short rent of homestay is defined from the perspective of law, and it is distinguished from similar concepts. Secondly, the development of shared short rent of homestay in China is briefly introduced.
In the second part, the paper expounds the home stay facility shared between short rent exist in legal subject and its legal relationship, and an overview of the home stay facility in China to share rent legal regulation of the current situation and existing problems of current our country legal system of home stay facility sharing short rent, on the basis of legal issues from within and outside the legal problem of two aspects that problem of home stay facility sharing rent legal system in our country.
In the third part, by referring to the regulatory legal systems of countries that are leading in the development of shared short rent of homestay, including the United States, Britain and Japan, and by comparing the regulatory legal systems of these three countries, summarize the beneficial experience of improving the regulatory legal system of hared short rent in China.
In the fourth part, through the analysis and summary of the above three parts, recognizes the deficiencies of China's legal system of homestand shared short rent, and on the basis of learning from foreign beneficial experience and combining with China's objective actual situation, puts forward feasible suggestions for the legal regulation of China's homestand shared short rent.
