摘 要

第二次世界大战之后，非国际性武装冲突在世界的各个角落频繁发生，大量平民流离失所，无辜受难已然成为事实，因此如何利用国际人道法对平民进行保护就显得十分重要。本文从四个章节做出阐述，第一章剖析国际人道法、非国际性武装冲突、平民三个概念，并且把相近的、容易混淆的概念与之区分。特别是平民的定义，分析定义方式背后的原因，并且把平民和战斗人员作出区分，通过比较更加清楚平民概念的本质。第一章对于概念的梳理也为下面两章的写作做一个铺垫。第二章梳理了在非国际性武装冲突中国际人道法的应用，以对平民的保护作为视角。分析现有的国际条约和习惯国际法的具体规定和在实际武装冲突中的应用情况，同时也会把不同国家的态度拿来做对比。第三章立足于第二章的基础之上，分析现有的国际人道法对于规制非国际性武装冲突中的平民保护存在的不足之处，分别从主权国家的抗拒、现存的国际法规的不完善之处、国际人道法执行的力度弱三个方面提出问题。最后针对第三章的问题，第四章提出了一些对策，依次探讨国际组织例如联合国、红十字会可以在促进平民保护中起到的作用，国际法规的完善，以及国家和国际社会增强知识的宣传，共同营造守法氛围。

Abstract

After the Second World War, non international armed conflicts occurred frequently in every corner of the world. In fact, a large number of civilians were displaced.In this situation, how to use international humanitarian law to protect civilians is very important. In this paper, four chapters are used to elaborate, the first chapter analyzes the three concepts of international humanitarian law, non international armed conflict and civilians, and distinguishes the similar and confusing concepts from them. In particular, the definition of civilians, analysis of the reasons behind the way of definition, and distinguish civilians and combatants, through comparison, to better understand the essence of the concept of civilians. The first chapter of the concept of combing for the next two chapters of writing to do a foreshadowing. Chapter two analyzes how international humanitarian law is applied in non international armed conflicts from the perspective of protecting civilians. This paper analyzes the specific provisions of existing international treaties and customary international law and their application in actual armed conflicts, and at the same time compares the attitudes of different countries. The third chapter, based on the second chapter, analyzes the shortcomings of the existing international humanitarian law in regulating the protection of civilians in non international armed conflict, and puts forward problems from the resistance of sovereign states, the imperfections of existing international laws and regulations, and the weak implementation of international humanitarian law. Finally, the fourth chapter puts forward some countermeasures to solve the problems in the third chapter. It discusses the role that international organizations, such as the United Nations and the Red Cross, can play in promoting the protection of civilians, the improvement of international laws and regulations, as well as the enhancement of publicity and the promotion of law-abiding atmosphere.

1. 绪论

国际人道法的宗旨和目的一直是减小战争对于人民的伤害，其中保护战争的受难者——平民，更是其核心要义。第二次世界大战之前，国家间的武装冲突经常发生，国际人道法也是基于这些国际武装冲突发展起来的。在冷战结束之后，国家的战争权被联合国宪章禁止，这一改变有效的减少了国际性武装冲突的发生频次，但并没有使国际社会处于和平稳定的状态，因为非国际武装冲突发生的更加频繁了。因为非国际性武装冲突涉及到国家主权等问题，情况更加错综复杂，这也给法律的适用和对平民的保护带来了更多挑战。

在非国际性武装冲突频发的背景下，如何适用国际人道法来保护平民是法学界讨论的热点问题。国际人道法对国际性和非国际性武装冲突都有规定，其中关于国际性武装冲突，四则日内瓦公约^[1]和《日内瓦第四公约关于保护国际性武装冲突受难者的附加议定书》都起着很大作用，其中《战时保护平民之日内瓦公约》具体规定了对平民的保护。关于非国际性武装冲突，有1949年共同第三条和《日内瓦第四公约关于保护非国际性武装冲突受难者的附加议定书》可以适用。虽然都有明确的国际条约来规范两种武装冲突、保护平民，但是在各种媒体的报道上依然可以看到武装冲突中平民受到严重迫害的新闻，由此可见，如何强化关于平民保护的法律规范是应该引起重视的问题。除此之外，根据各种新闻报道和统计数据可见，在两种武装冲突受到伤害最多的都是是处于弱势地位的平民，而就战争的作战手法和惨烈程度来看，非国际武装冲突在这两个方面不亚于国际武装冲突，而且情况更甚，但适用于非国际武装冲突的国际人道主义法并不多。由此看来在非国际性武装冲突中，适用国际人道法来保护平民仍然有许多需要完善的地方。
