摘 要

中国近年来各项工业战略产业的发展历程特别是芯片产业，事关我国相关产业供应链的顺畅，事关国家的经济安全，事关我国的战略布局，事关我国经济的长治久安。总而言之，工业新兴战略产业的发展至关重要。但是，由于各种复杂的原因，工业新兴战略产业的发展在我国却并不理想，甚至成为制约我国经济长期向好、向稳发展的瓶颈。发展工业新兴战略产业将成为今后相当一段时期我国面临的重要任务。从短期来看，工业新兴战略产业的发展离不开法律制度的大力扶持和促进。我国应如何制定法律制度规划以何种方式、采取多大程度来扶促这些新兴战略产业发展应该是立法短期内的一项重要任务。本文对我国目前国内新兴战略产业发展的形势进行明确的分析，深度了解我国法律扶持的现状以及困难，总结我国发展新兴产业扶持以来出现的问题和坚持走可持续发展的道路，明确我们发展的目的和要求，精准帮助需要扶持并且能够推进我国经济技术科技发展的产业，从财政负担，法律制度建设，扶持政策性和法律规定性的衔接与同步，以及扶持的当前性与长远性等多方面考量，最后对分析的结果进行研究充分做到扶持的合理性和公平性，合理的分配扶持的财政性负担，加强完善扶持的法律制度建设。

Abstract

The development history of various industrial strategic industries in China in recent years, especially the chip industry, is related to the smooth supply chain of China's related industries, the economic security of the country, the strategic layout of China, and the long-term stability of our economy. All in all, the development of industrial emerging strategic industries is crucial. However, due to various complicated reasons, the development of new industrial strategic industries is not ideal in China, and even becomes a bottleneck restricting the long-term improvement and steady development of China's economy. The development of industrial emerging strategic industries will become an important task facing our country for quite some time to come. In the short term, the development of emerging strategic industries in industry is inseparable from the strong support and promotion of the legal system. How China should formulate the legal system planning, in what way, and to what extent, to promote the development of these emerging strategic industries should be an important task in the short term of legislation. This article makes a clear analysis of the current situation of China's emerging strategic industry development, in-depth understanding of the status and difficulties of China's legal support, summarizes the problems that have arisen since the development of China's emerging industry support and adheres to the path of sustainable development, and clarifies our development goals And requirements, and accurately assist industries that need support and can promote the development of China's economic, technological and technological development, from the aspects of financial burden, legal system construction, support for the convergence and synchronization of policy and legal provisions, and the current and long-term nature of support. 工业战略产业被喻为国家发展的“脉搏”，是各个国家相互之间政治，经济等方面竞争的力量基础，是一个国家高科技建设以及全面发展能力的综合体现。其内容之丰富，种类之多，是建设国家，增强国力的必要因素，以芯片制造产业为例子，其应用范围之广泛可以促进我国多方面产业发展的进步，例如计算机、汽车电子、云计算、节能发展。以及新兴电子通讯网络等发展领域。而中国又恰好在这方面有着得天独厚的优势，因为中国有着全球最大的半导体市场，并且已然成为继美国之后的全球第二大集成电路设计重镇，正因为目前我国的集成电路的主流产品仍然主要集中在中低端产品，所以现在中国发展芯片产业依然存在着一系列的问题，我国高端芯片仍然依靠从国外进口，每年我国集成电路的进口额也仍然在2000多亿美元，连续多年位于我国进口产品中的榜首，论文内容主要分析如何对进口高端集成电路芯片进行扶持政策，并且为我国基础芯片建设提供推进力量，大力优化发展我国的新兴战略研究氛围以及研究加速发展。从长远发展的角度，把目光放在更宏观的角度来看，从制度根本上解决我国新兴战略产业发展的局限性，提高我国发展的进程，加速发展我国高新技术产业，在未来的发展上加大扶持力度，坚决做到扶持的公平性与合理性，合理分配扶持的财政性负担，实现扶持的政策性和法律规定性的衔接与同步。把握好扶持的当前性与长远性。
