摘 要

改革开放后,随着社会的快速进步,毒品,这个在中国已经消失了很多年的社会顽疾重新浮出水面,严重危害了我国的社会稳定,阻碍了经济的发展。毒品犯罪已经成为全世界共同的难题,全世界在和毒品犯罪作斗争,但是毒品犯罪非但没有灭亡，反倒不断危害着世界的安宁。本文根据当今世界毒品犯罪的一些情况，探索法律对毒品犯罪的限定，并对中国毒品犯罪的一些问题进行思考。发现毒品犯罪产生的一些原因以及治理毒品犯罪的办法。

文章内容主要分四部分：第一、毒品犯罪基本理论。简单描述了毒品的概念和特性及毒品的种类,让我们知道什么是毒品。第二、毒品犯罪的现状及其原因。讲述了国内外毒品犯罪的情况,从历史和现实两方面阐述毒品犯罪产生的原因。第三、简述了当今社会打击毒品犯罪中遇到的困难，首先是如何认定的问题，如何对吸毒人员涉毒犯罪的认定问题，其次是如何依法处罚问题。第四、对毒品犯罪和量刑标准的认定，对贩卖毒品罪的既未遂标准认定,认为非法持有毒品具有六个特征,并对难点问题进行了剖析。吸食、注射毒品者非法持有毒品的定性、盗窃、抢夺、抢劫毒品行为的定性、“以贩养吸”的认定等问题。

ABSTRACT

Since Reform and Openness ,with the rapid development of economy drug,which vanished dozens of years ago as a sort of social filthy phenomenon ,reappears.Drug has brought more and more harm,which has corrupted social organism,ruined social ethos,endangered social stability and hampered economical development.Drug crime has become a global difficult problem in the world.All of the countries fight against drug showing the utmost fortitude,however drug crime has increased more and more promptly.From the angle of view of judicial practice of drug crime the author reviews the provisions of drug crime in Criminal Law,and at the same time explores the recent situations and problems of the trial of drug crime cases.

The following article is divided into four parts: First, an overview of drug crime. First outlined the concept and characteristics of drugs and drug types, so we know what drug. Second, the history and status quo of drug crime. Briefly describes the status of the global drug crime, then it introduces the history and current situation of drug crime. Causes of drug crime from the perspective of historical and realistic point of view. Third, outlined the difficulties in today's society in the fight against drug crime encountered the first problem is how to identify, how to identify problem drug users in drug-related crime, and secondly how the punishment according to law. Fourth, drug-related crimes and sentencing criteria for the determination of attempted drug trafficking both standard finds that the illegal possession of drugs has six characteristics, and difficult problems were analyzed. 第1章绪论

1.1研究毒品犯罪的背景

对于我国绝大多数人而言，毒品和毒品犯罪其所产生的影响与其它犯罪相比，更具有特殊性。从历史上来看，中国半殖民地半封建社会的历史始于1846年的鸦片战争，鸦片贸易导致的丧权辱国的历史成为了每个中国人心中永远无法抹去的痛苦，单从这点来看，这种犯法情势在我国比其他犯法情势都使我们恐惧，以至于当局者及公众还觉得当使用了极刑等处罚来惩治毒品犯罪时，惩治的力度还不够。

1.2研究毒品犯罪的目的

毒品犯罪，从来都是中国法律重点监督和打击的对象。毒品作为万恶之源，己经使相当多原本幸福的家庭破碎，它不仅残害人类的健康的同时还导致大量犯罪行为的发生，极大地提高了我国的犯罪率。近些年,虽然我国对毒品的打击工作不断增强，但打击工作却逐渐难以开展，其所面对的情势依然很困难。基于此，中国刑法以专门的章节总结了毒品犯罪的各种罪名，是打击毒品犯罪的重要基石。鉴于这些原因，本人试图联系毒品和毒品犯罪，综合国内外毒品犯罪现状，对我国立法的不足进行反思，以解决实践中出现的问题，真真做到法律能有效打击到毒品犯罪。
