摘 要

人工智能技术作为近几十年才发展出现的一个新兴学科，发展十分迅猛。在人工智能技术飞速进步、不断带给人类便利的同时，也带来了诸多法律问题。怎样将人工智能技术规制在一个合理的范围内，从而使其更好地为人类服务，是本文关注的研究焦点。

我们的探究从人工智能技术的起源和发展入手，充分理解和认识了人工智能技术带给了人类社会前所未有的巨变；在考察了人工智能技术与法律、特别是民法等部门法之间的关系之后，可以看出目前我国法律、特别是民法存在的空白之处，生活中已有若干现实案例可以管窥。另外，通过对美国、日本、欧盟等国家和地区人工智能技术现实应用的比较研究，以及对这些发达国家和地区人工智能技术的法律规制进行了解，为我国人工智能技术的法律应对发现了一些有益思路。

在进行上述考察分析和比较研究之后，我们对人工智能技术的伦理规范与法律保留的结合有了自己的认识，并对人工智能技术的未来发展以及民法的应对提出了若干构想。

Abstract

Artificial intelligence technology has emerged as a new discipline that has only developed in recent decades,and its development is very rapid.While technological advancement has brought human convenience,artificial intelligence technology has also brought many legal issues.How to regulate artificial intelligence technology within a reasonable range so as to better serve humanity will also be discussed in this article.

This article can be divided into four parts roughly:First of all,it elaborates and analyzes the origin and development of artificial intelligence technology,and affirms the changes that artificial intelligence technology brings to human society.Next,the relationship between artificial intelligence technology and civil law and its subordinate department law is analyzed.Point out the current gaps in the law,and enumerate several cases to demonstrate.Second,it discusses the real application of artificial intelligence technology in foreign countries.Including the practical application in the United States,Japan,Europe and other countries,providing reference templates for China's artificial intelligence technology legislation.

Finally,we look forward to the future of artificial intelligence technology and the countermeasures of civil law,including the combination of legal reservation and ethical norms of artificial intelligence technology.

一、人工智能技术的概述

（一）何为人工智能技术

1.人工智能技术的渊源

何为人工智能？顾名思义，它是探索一种新的能以人类智能相似的方式做出反应的学科。它的英文名称Artificial Intelligence,缩写为AI。它是探索、开发用于模仿、延长和扩展人的智力的理论、方式、技术及应用系统的一门全新的技术科学。人工智能实际上只是计算机科学领域内的一个部分，它试图探索智能的实质。该领域涉及范围很广，包含仿人型智能机器人、语言归类、图像辨别、自然语言解析和专家系统等。

人类在最近几年对于人工智能技术的探索和了解有了巨大的进步，人类早已在这一领域取得了十分广泛且划时代的突破成果，但其实人工智能技术的发展只有短短几十年。1956年，麦卡塞、明基斯、罗切斯特和申农等一众青年才俊在一次聚众讨论上，对机器模拟人类这一问题进行了广泛地交谈并且第一次提出了“人工智能”这一概念。很快，人工智能技术便快速地发展起来，作为一个全新的领域，其与基因工程，纳米科学合称为21世纪最顶尖的三大技术，引发了21世纪的科技革命。
