摘 要

检察官作为我国法律监督机关的司法工作人员，行使检察权。为保证其行使法律监督权的效率性和公正性，维护其人身、财产、安全等方面不受影响，全面可行的职业保障制度显得尤为重要。职业保障制度水平的提升不仅可以影响检察官群体的合法利益和荣誉，更事关司法公正和司法权威的需要。在司法体制改革背景下，党的十八届四中全会通过的《决定》以及最高人民检察院出台的《意见》为完善检察院司法责任制提供了指导性意义。检察官职业保障制度作为司法责任制改革的重要组成部分，为建立和完善检察官职业保障制度，本文将结合现实问题，对改革过程中的运行状况，面临的挑战和问题进行分析，总结出现行职业保障机制的不足，并结合改革动态和进展提出可行有效的建议。

Abstract

Prosecutors act as judicial officers of China's legal supervision organs and exercise agent power.In order to ensure the efficiency and impartiality of the exercise of legal supervision, it is of great importance to protect the personal, property and safety aspects.The improvement of occupational security system can not only affect the legal interests and honor of the public prosecutor, but also the need of judicial justice and judicial authority.Under the background of the judicial system reform, the party 18 by the fourth plenary session of the "decision" and the supreme people's procuratorate issued the "opinions" to improve the people's procuratorate of the judicial system provides guidance significance.Prosecutor professional security system as an important part of the reform of the judicial system, in order to establish and perfect the prosecutor professional guarantee system, this paper will be combined with the practical problems, the reform in the process of running status, facing the challenges and problems were analyzed, and summarizes the lack of a line of professional guarantee mechanism, and put forward feasible and effective combined with dynamic reform and progress.

一、检察官职业保障制度概述

检察官职业保障制度是我国检察体制改革的重要组成部分。检察官的职业保障内容主要包括职权保障、身份保障、物质保障以及人身保障。其目的就是让检察权的公平与正义要求得以实现，使检察职业能够更加正规化、专业化、精英化。对保证检察官独立行使职能、排除外来的各种干扰，实现司法公正，都具有十分重要的意义。

（一）司法责任制改革对检察官职业的影响

检察官职业保障制度是司法责任制改革中重要内容，同时也是研究检察体制改革中的一个基本的课题。对于完善检察官职业保障制度，国内理论界、实务界早已展开过热烈的讨论，对我国检察官职业保障制度的运行现况、实践中的问题以及因果关系进行了系统的分析。但是司法责任制改革却对检察官职业提出了全新的要求，也产生了重大的影响，因此在司法责任制改革背景下研究如何完善职业保障制度具有更强烈的时代意义。

司法体制改革在十八大召开以来一直在稳步进行，司法责任制是其重要组成内容。最高人民检察院2015年9月通过的《关于完善人民检察院司法责任制的若干意见》（以下简称《意见》），使落实司法责任制有了稳固的基础和基本遵循。为避免检察院、法院在行使职权的时候不受任何外界干扰，我国从十五大起就把它作为推进我国司法权完善的目标，直至十八届四中全会才得以落实，这是一项巨大且具有进步意义的工程。
